Article 1 - Definitions

In these terms and conditions the following terms shall have the following meanings:

  1. Cooling-off period: the period within which the consumer can make use of his right of withdrawal.

  2. Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

  3. Day: calendar day.

  4. Duration transaction: a distance contract relating to products/services, the delivery and purchase of which are spread over time.

  5. Durable medium: any instrument which enables the personal storage of information for future reference.

  6. Right of withdrawal: the consumer's option to cancel the distance contract within the cooling-off period.

  7. Model form: standard form for withdrawal, made available by the entrepreneur.

  8. Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.

  9. Distance contract: contract whereby exclusive use is made of one or more techniques for distance communication.

  10. Distance communication technology: means that can be used to conclude an agreement without a physical meeting.

  11. General Terms and Conditions: these terms and conditions of Clinita Benelux.

Article 3 - Applicability

  1. These conditions apply to every offer and every distance contract between Clinita Benelux and the consumer.

  2. These terms and conditions are made available prior to the agreement and can be easily saved by the consumer.

  3. Any deviating conditions must be agreed in writing.


Article 4 - The offer

  1. Offers are without obligation and clearly described. Errors do not bind Clinita Benelux.

  2. Images are indicative; deviations in colour may occur.

  3. All prices are exclusive of VAT and exclusive of any shipping costs, unless otherwise stated.


Article 5 - The Agreement

  1. The agreement is concluded after acceptance by the consumer and confirmation by Clinita Benelux.

  2. Clinita Benelux takes appropriate security measures for electronic traffic and payment.

  3. Delivery of products is subject to availability.


Article 6 - Right of withdrawal

  1. The consumer has the right to cancel the agreement within 14 days of receipt.

  2. Products must be returned in their original condition and packaging.

  3. Revocation must be made known using the model form or by e-mail within 14 days.


Article 7 - Costs in case of revocation

  1. Return costs are the responsibility of the consumer.

  2. Refunds will be made within 14 days of receipt of the product or conclusive proof of return.


Article 8 - Exclusion of the right of withdrawal

Exclusion applies to sealed hygiene products where the seal has been broken and to custom-made products that have been produced specifically at the request of the consumer.


Article 9 - The price

Prices will not be increased within the stated period of validity, unless legal changes make this necessary. Printing and typographical errors excepted.


Article 10 - Conformity and warranty

Clinita Benelux guarantees that products meet the agreement, specifications and legal requirements. Warranty does not apply in case of careless use, repairs by third parties or exposure to abnormal conditions.


Article 11 - Delivery and execution

Orders will be processed within 14 business days unless otherwise stated. Clinita Benelux is not liable for delays beyond its control.


Article 12 - Duration transactions: duration, termination and extension

Consumers may terminate agreements for an indefinite period at any time with a notice period of up to one month. Silent renewal occurs exclusively in accordance with statutory provisions.


Article 13 - Payment

Payment must be made immediately upon purchase, unless otherwise agreed. Consumer reports any inaccuracies in payment details immediately.


Article 14 - Complaints procedure

  1. Complaints must be submitted fully described within 14 days via info@clinita.shop .

  2. Clinita Benelux will respond within 14 days. If more time is needed, the consumer will be informed.

Clinita Benelux is currently not affiliated with a dispute committee.


Article 15 - Disputes

Agreements with Clinita Benelux are exclusively governed by Belgian law. The Vienna Sales Convention is excluded.


Article 16 - Additional or deviating provisions

Any deviations from these conditions may not be to the detriment of the consumer and must be recorded in writing.
